Functions of law in non-democratic regimes of the twentieth century

An assumption, sometimes not outspoken, of those who allege a current crisis of democracies is that the overlap between law and non-democratic politics is unprecedented. They mention strategic uses of law as a tool for these regimes, as if in the past it had not been mobilized as well, and the phenomena experienced had occurred at its margins. This, however, is not a suitable account of the past. In the present article, I argue that classical authors from the studies on political transitions can help to consolidate a theoretical field on this matter, and that law, in their views, may have served at least four different and non-isolated roles in non-democratic regimes of the shortened twentieth century (1914-1989). The article is divided into four
parts. First, I introduce the current topic and the non-explicit assumption of
debates about the alleged crisis of democracies. Then, I expose the
methodology and concepts employed by the authors discussed. Third, I
outline a typology of the functions of law in non-democratic regimes. Finally,
I conclude that such a typology may have further theoretical deepening and that current authors should turn to past discussions about law and the
absence of democracy
