Abstract

The objective of this study is to analyze the reasons that justify the unconstitutionality of subcontracting in the provision of public services by private individuals without prior bidding in the Brazilian economic order. For this, the methodology used in this article was the hypothetical deductive method, using bibliographies, articles and doctrine as research elements. Reasons will be listed to demonstrate the unconstitutionality of subcontracting without prior bidding, considering aspects of the principles Administrative law, the 1988 Federal Constitution and constitutional principles.
