About the Journal

Focus and Scope

The Revista de Direito Sanitário/ Journal of Health Law has the mission of disseminating knowledge and stimulating discussions in the interdisciplinary field of health law, regardless of the authors’ research area.

The publication is aimed to professionals in the areas of health law, public policy, law and public health, as well as researchers, teachers and students of these areas.

The journal is not thematic and its issues are organized according to the received contributions.

The journal publishes only original manuscripts that are submitted exclusively for the journal, written by Brazilian and/or foreign researchers.

The journal does not publish review articles, either translated articles from other publications.

The papers submitted must be original and submitted only to the journal. Once accepted, the paper cannot be disclosed until its publication by the Revista de Direito Sanitário/ Journal of Health Law . Authors can share and discuss the research data at scientific events, with their colleagues or press, but they cannot distribute copies of the paper before its official publication.

In case of paper presented at scientific events, the authors should indicate the name of the event, the place and date of the meeting. In case of paper based on a thesis it should be informed the name of the institution and year of the thesis.

The Revista de Direito Sanitário/ Journal of Health Law adopts the double-blind review process to evaluate the papers.

The publication does not charge the authors in any circumstances. All stages of our submission process are free of charge.

Peer Review Process

In a brief

FIRST STAGE: field of study and editorial policy

All papers submitted to the Revista de Direito Sanitário/ Journal of Health Law are evaluated if they are adequate to the health law field and to the editorial policy of the publication. 

SECOND STAGE: editorial rules

The papers should attend to editorial requirements of the Revista de Direito Sanitário/ Journal of Health Law and also present:

(a) title, abstract and keywords;

(b) author’s affiliation and a short curriculum;

(c) complete references; and

(d) maximum number of characters.

 

THIRD STAGE: scientific development

Based on the journal's mission, the Editorial Board analyzes if the paper contributes to the scientific development of the health law.

FOURTH STAGE: scientific evaluation

All manuscripts submitted to Revista de Direito Sanitário/ Journal of Health Law are analyzed by referees in charge of assessing the scientific merit of the documents. This assessment is made through a double blinded process in which reviewers have no knowledge of the authors and vice versa.

The referees of the Revista de Direito Sanitário/ Journal of Health Law  are members of its Editorial Board as well as external experts.

IMPORTANT NOTES: 

1) The recommendations and opinions issued by the Ad hoc reviewers are guidelines to improve the scientific quality of the manuscript. The Editorial Board is the highest organ of the Revista de Direito Sanitário/ Journal of Health Law for all decisions involving publication’s issues, including the acceptance or not of submitted manuscripts.

 2) The authors are reported on all stages of the evaluation process.

 

Publication Frequency

Three editions per year, in March, July and November.

Open Access Policy

This journal provides immediate open access to its content based on the principle that scientific knowledge freely available to the public provides greater democratization of knowledge worldwide.

Sections

Original papers: Presentation of papers which present distinguished approaches and stimulate the reflection about new ideas and concepts related to the field of health law.

Argument: Section presenting series of original papers, dealing with a single theme and discussing the results of research on current and controversial issues.

Jurisprudence in perspective/ Case studies: This section is dedicated to the analysis of important lawsuits regarding health law, from Brazil and abroad. It is a guide for those interested in the legal efficacy of these fields.

Jurisprudence: An assemblage of juridical decisions on health law from Brazil and worldwide, approaching subjects such as institutional organization of health services, right to the health services, health and environment, consumer's right to health services and products, among others.

Reviews: Section dedicated to book reviews of Brazilian and foreign authors, covering topics in the fields of health law, law and public health with a focus on health law.

Best Practices

Editors, refeeres and authors should accept the terms of the editorial police of the journal.

The Revista de Direito Sanitário/ Journal of Health Law adopts Creative Commons license “Attribution 4.0 International”. This license allows to "Share — copy and redistribute the material in any medium or format; Adapt — remix, transform, and build upon the material for any purpose, even commercially."

Authors who submit papers to the Journal should accept the terms of this license.

Ethics

The Revista de Direito Sanitário/ Journal of Health Law adopts Singapore Statement on Research Integrity (http://www.singaporestatement.org/statement.html).

All editors, refeeres and authors are responsible to act according to ethical values of the Singapore Statement on Research Integrity.

In all researches, with human beings or not, authors should assure that were taken in consideration all ethical and appropriate procedures.

The Revista de Direito Sanitário/ Journal of Health Law rejects any scientific misconduct such as falsification and fabrication of data, plagiarism, misappropriation of ideas, or data manipulation and quotes. Any scientific misconduct complaint will be confidentially investigated, and it will be taken all appropriate action for the correction of confirmed errors.

Authors responsability

All authors of the manuscript must have contributed to its elaboration and should know its contents. Papers submitted to the Revista de Direito Sanitário/ Journal of Health Law should be accompanied by a responsibility document.

The views expressed in papers published by the Revista de Direito Sanitário/ Journal of Health Law are the sole responsibility of their authors.

Conflicts of interest

Authors who submit to the Revista de Direito Sanitário/ Journal of Health Law should inform the publication the existence of potential conflicts of interest of academic, professional, political, personal or financial nature.

It also applies to the scientific reviewers of the manuscripts, which must declare themselves ineligible to evaluate a paper, if there is a potential conflict of interest, for example, knowledge of the papers authors or lack of familiarity with the subject area of study.

The members of the Editorial Board of the publication shall also inform about potential conflicts of interest.

In case of doubts about the existence of potential conflicts of interest, authors, referees and editors should consult the scientific editor of the Revista de Direito Sanitário/ Journal of Health Law.

Funding

In case of research done with public and/or private funding, the authors should indicate the funding institution, the title of the financed project and the number of identification.
