Prior consultation and the resolution of territorial conflicts in the framework of legal pluralism: the case of the Kichwa of the Yasuní (Ecuadorian Amazon)

This article is based on the experience of fieldwork carried out between 2013-2016, when we had the opportunity to accompany the organization of the Kichwa indigenous people of the Yasuní (Ecuadorian Amazon) against the intensification of oil extraction in their territories. Taking into account the particular Ecuadorian context characterized by the inscription of legal pluralism in the political Constitution (2008), this analysis will have two main objectives: 1. To indicate the impact of the plurinational constitutional reforms in the field of indigenous peoples' rights and the possibilities and limits of the application of these reforms in extractive contexts; 2. To address the way in which the Kichwa have appropriated the discourse regarding their rights -especially the right to prior consultation and consent-, as a contra-hegemonic tool to denounce the violence that indigenous peoples experience and to destabilize the official discourse of development understood from the logic of the market and transnational capital.
