Abstract

In a recent study on democracy and constitutionalism I noted from the very first moment the famous Roman proclamation: Ubi societas, ibi ius. Indeed, it seems a commonplace to affirm that wherever there is a society, there is Law. Nonetheless, the question to be examined affects the quality of this law, the source from which it emanates, and the nature of the institutions that support it. In short, it is a question that once again has emerged with renewed potential. Coming into the 21st century, the age of technological sophistication, cloud communication, and a globalized context, the world, its individuals, or at least the ones most aware, are again scrutinizing the thorny field of political formulas in seeking the arrangement that will ensure freedom. This, in a territory endowed with security and the feeling that those in political power can be relied upon.
