Abstract

With the growth of interests by the academy in the study corruption, it is important to move forward towards the verification of facilitating sources in the legal framework in the administrative field. The main hypothesis is the same Law can create opportunities to the corruption, instead of fighting against it. Through a critical bibliographic analysis, it is intended to demonstrate that the legislation about public procurement favors corrupt practices, through an exam of costs and benefits, evaluation the level of its favoritism given by the same law to the eventually corrupt agents.
