Abstract

This is an analysis of the constitutional devices, in Brazil relative to the role of State and its relationship with Tourism. This relationship deals with the protection of the Tourist Patrimony (in an ample sense) and with the incentives (the tributary ones included) to the development of Tourism, in priority areas, destined to promote a larger balance in the socioeconomic development of the regions. This analysis distinguishes the State competences connected directly to the Union, to the States and to the Federal District, which can be explained as due to all Federation spheres, the municipal one included.
